Terms and conditions

These terms govern the use of The North West Mercury (northwestmercury.co.uk) and the ordering of publications.

1. Who we are

The North West Mercury is a digital newspaper published by Troc Media, a brand of Trocalia Digital S.L. (Spanish tax ID (CIF) B70751490; VAT number ESB70751490), with its registered office in Barcelona. Contact: info@northwestmercury.co.uk.

2. Use of the newspaper

You may read, link to and share our articles freely. To reproduce them in full or for commercial purposes, you need our permission.

3. Publication service for businesses

The North West Mercury offers companies, organisations and professionals the publication of news about their activities. The text may be written by the client or prepared by our writing assistant, which uses artificial intelligence, based on the information the client provides to us or that appears on the client’s website. In every case the client reviews the text and images before paying and, by paying, confirms their publication.

Depending on the package purchased, the article is published in the newspaper and, where the package includes it, also in other newspapers in our network, and may be translated into their languages. The features of each package (newspapers, languages, links and price) are those shown before payment.

The article is published once payment has been confirmed and remains published indefinitely for as long as the newspaper is in operation, unless it is removed for the reasons set out in section 6 or at the client’s request.

4. Client obligations

By placing an order, the client undertakes to:

  • Provide truthful information and review the text before it is published, including when it has been prepared by our assistant.
  • Hold the rights to the texts, images, logos and trade marks that they provide to us, or that appear on their website and they ask us to use.
  • Not publish content that is unlawful, misleading or defamatory, that infringes the rights of third parties, or that is contrary to our Editorial policy.

5. Licence

The client authorises us, on a non-exclusive and royalty-free basis, to publish, translate, adapt and distribute the content in the newspaper, in the other newspapers in our network where the package includes them, and on our channels and social media, for as long as it remains published.

6. Editing and removal

We may adapt texts to our style and remove any content that breaches these terms, our editorial policy or the law, or whose removal is required by an authority or by a third party entitled to require it. If content is removed because the client has failed to comply with these terms, the client is not entitled to a refund.

7. Prices and payment

Prices are shown before payment and do not include VAT, which is added where applicable under the relevant regulations. Offers state their period of validity. Payment is made through Stripe, which issues the invoice.

8. Right of withdrawal and refunds

The service is performed when the article is published, at the client’s express request on confirming payment. For this reason, once the article has been published, the right of withdrawal does not apply and no refund is given. If a technical error on our part prevents publication, we refund the amount paid.

9. Liability

The client is responsible for the content they publish and for the information they provide to us. Except in cases of wilful misconduct or gross negligence, our liability is limited to the amount paid for the publication concerned.

10. Changes to these terms

We may update these terms. Each order is governed by the version in force at the time of payment.

11. Governing law and jurisdiction

These terms are governed by Spanish law. For any dispute, the parties submit to the courts of Barcelona, without prejudice to any mandatory consumer protection rules that may apply.
